Terms:
• The SOFTWARE PRODUCT is licensed for use, not sold. All title and copyrights to the SOFTWARE PRODUCT, including but not limited to algorithms, data structures, user interface design, database design, program logic structures & statements, are owned by Abuzar Consultancy, and are protected by Copyright Laws. The SOFTWARE PRODUCT is being licensed for use as an off-the-shelf ready-made product. Any changes or improvements in software would be at Abuzar Consultancy’s discretion.
• This end-user Software Usage License Agreement pertains ONLY to the application SOFTWARE PRODUCT developed by Abuzar Consultancy and does not include any hardware (Computers, Printers or Network Accessories etc) or any system software (Operating Systems, Network Operating system, Database Management System etc). Provision of all such facilities will be client’s responsibility.
• This License Agreement gives the client right to use the software for a period of one year from the date of installation. Abuzar Consultancy warrants that the SOFTWARE PRODUCT will perform substantially in accordance with the accompanying written materials and user training provided by Abuzar Consultancy for this period. After expiry of One Year (from the date of installation) Annual License Renewal Contract must be done for Rs.7, 000 per year, if the client wants to use the software for next year. This License Agreement is Non-Transferable and is valid only for the original licensee of the SOFTWARE PRODUCT.
• Abuzar Consultancy categorically states that this end-user software usage license and the subsequent warranty, service, & version upgrades are ONLY for the application SOFTWARE PRODUCT developed by Abuzar Consultancy. The client must refer to the respective manufacturers or their authorized agents for the licensing, installation, configuration, & warranty/service of other software required such as Operating system, Network operating system and Database Management System, as required by the Copyright Laws. Abuzar Consultancy has NO alliance or partnership or dealership of any other Software Development Company whatsoever.
• Abuzar Consultancy disclaims all other warranties, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, with regard to the SOFTWARE PRODUCT. In no event shall Abuzar Consultancy be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the software product.
